The Right to Access Public Railway Infrastructure

In EU member states, carriers and other interested applicants with headquarters in one of EU member states have the right to access the railway infrastructure.

Carriers are companies whose main activity comprises performing i.e. providing railway transport services, which have appropriate licenses for providing said services, and which provide train haulage. They can also merely provide train haulage and have a license for such services.

Applicants are carriers or other legal entities which need a train path for public (state, local community, public utility service provider) or commercial (freight transport providers, freight brokers, intermodal transport providers) interest.
If an applicant is not a carrier, it must conclude a contract with one of the carriers with a valid license and safety certificate to provide railway transport services.

Carriers who wish to provide freight or passenger railway transport services on the public railway infrastructure in the Republic of Slovenia must acquire a license and safety certificate, which may be valid in the entire territory of the Republic of Slovenia or only a part thereof. Applications for licenses and safety certificates may be filed by carriers registered as railway transport service providers in the Republic of Slovenia.

Issuing licenses and safety certificates to railway transport carriers is under the authority of the Public Agency for Railway Transport of the Republic of Slovenia.

To gain access to the public railway infrastructure in the Republic of Slovenia, a carrier must have an allocated train path, a contract on access concluded with the public railway infrastructure operator, and a contract on charging the user fee with the Public Agency for Railway Transport of the Republic of Slovenia.
