The Agency decides on the complaints filed by entities in railway transport, by which it provides fair and equitable access to public railway infrastructure and encourages competition in the railway service market. The Agency takes action ex officio if it finds violations of free competition, violations of legislation regarding the allocation of train paths, or regarding setting and charging the user fee.
When making decisions regarding individual administrative matters, the Agency acts in accordance with the law regulating general administrative procedure, if the issues are not regulated otherwise by the Railway Transport Act.
The Agency makes decisions within two months of receiving all the information required for the decision at the latest. The Agency’s decision is final and binding for all the parties in the procedure, and an administrative dispute may be launched against its decisions.
The Agency decides on the complaints filed by applicants or other parties in interest related to:

criteria in the network statement,

the allocation of train paths,

setting and calculating the user fee,

issuing licenses to carriers,

equitable access to public railway infrastructure,

other issues of key importance for the equitable use of public railway infrastructure.
